Indeed. There could be some issues. It is up to them to be transparent about it if they want to earn and keep people's trust, so they need to be clear about what is going on.
I just don't like to see something instantly labeled a scam, based on very little information. If they are not a scam, their reputation will be damaged. If they are a scam then yeah, warn others about them.
